ALTUM ADVENTURES SRL: WAIVER AND RELEASE FROM LIABILITY

In exchange for being permitted to participate in the Activities defined below, I agree to the terms of this Waiver and Release from Liability and Assumption of Risk.

I. DEFINITION OF ACTIVITIES AND RELEASED PARTIES

I understand and agree that the "Activities" include, but are not limited to, Freediving, Spearfishing, Snorkeling, Yoga, Breathwork, workshops, ground transportation, water transportation, and any activities incidental or related to the instruction, supervision, or travel associated with the retreat, course, or other activity in which I am engaging with ALTUM ADVENTURES SRL.

The "Released Parties" are ALTUM ADVENTURES SRL, MOLCHANOVS (if applicable), and their respective officers, directors, agents, independent contractors, affiliated entities, volunteers, successors, assigns, and all other individuals connected to or acting on their behalf.

II. ASSUMPTION OF RISK

I fully understand and accept that the Activities offered have inherent dangers and significant risks which I will be exposed to by participating in them and travelling to Costa Rica, including (but not limited to) property loss, serious personal injury, and death. These risks include, but are not limited to:

  • Risks specific to water activities such as drowning, barotrauma, lung squeeze, equalization difficulties, and Shallow Water Blackout (SWB)

  • Risks related to travel, ground and water transportation, contact with marine life, and exposure to the sun and heat

I knowingly and voluntarily fully accept and assume all risks of participating in the Activities and accept personal responsibility for any damages, liabilities, or expenses arising from my participation.

III. HEALTH AND SAFETY CERTIFICATION

  1. I certify that I am in good mental and proper physical condition to participate in the Activities and have not been advised otherwise by a qualified medical professional.

  2. I certify that there are no health-related reasons or problems which preclude my participation.

  3. I confirm that I am not under the influence of alcohol or any other substances that could compromise my judgment or physical performance.

  4. I certify that I have current and sufficient travel and health insurance coverage that covers me for accident and injury in Costa Rica.

IV. WAIVER AND RELEASE OF LIABILITY & INDEMNITY

  1. I hereby release and forever discharge the Released Parties from any and all liability, and waive all claims, suits, and actions of any kind against the Released Parties, for death, disability, personal injury, property damage, theft, and any other loss or damages incurred that may hereafter accrue to me, my executors, administrators, heirs, next of kin, successors, and assigns, arising out of or in any way connected with my participation in the Activities, including liability, claims, losses, or damages resulting from the negligence of any party, including the Released Parties.

  2. I agree to adhere to and obey all local Laws.

  3. I agree to follow all instructions, rules, and procedures given by Altum Adventures SRL staff, guides, and instructors during the Activities. I understand that failure to do so may result in immediate termination of my participation without refund.

  4. I agree to indemnify, defend, and hold harmless the Released Parties from any and all costs, losses, claims, liabilities, damages, or expenses incurred by such Released Parties as a result of any claim or demand made against them in connection with my participation, or as a result of my actions or omissions during the Activities.

V. PHOTO RELEASE

I hereby grant and assign the right and permission for ALTUM ADVENTURES SRL to use and publish any photographs, film, video, electronic representations, and/or sound recordings of myself on any official communication channels (including but not limited to websites, social media, and promotional materials).

I release ALTUM ADVENTURES SRL from any and all liability from such use and promotion, and I waive any rights, claims, or interest to compensation, understanding that there will be no financial or other remuneration.

VI. GOVERNING LAW AND SEVERABILITY

  1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of The Republic of Costa Rica, and the parties agree to submit to the exclusive jurisdiction of the courts of Costa Rica.

  2. Severability: The terms of this waiver shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. If any part of this document is determined to be invalid by law, all other parts of this waiver shall remain valid and enforceable.

I CERTIFY THAT I HAVE READ THIS DOCUMENT IN ITS ENTIRETY, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT, AND I SIGN IT ON MY OWN FREE WILL.
